Man sues Fred Weber Inc. over Earth City landfill accident

Former Thoele Oil of St. Charles truck driver sues construction giant.

Former Thoele Oil of St. Charles truck driver Daniel Loeffelman has sued construction giant Fred Weber Inc. in St. Louis County Judge Michael T. Jamison’s courtroom.

According to court documents, Loeffelman, of St. Peters, alleges that on March 5, 2010, he was instructed to pick up waste materials at a location in St. Louis and take them to the Fred Weber solid waste landfill in Earth City.

Loeffelman says a Fred Weber employee him to go to a specific location on the 254-acre landfill. After dumping his load, Loeffelman’s dump truck overturned and Loeffelman says he was seriously injured.

Loeffelman also alleges in court documents that the area in which he was told to dump his load was soft and unstable and couldn’t support weight of his truck. Loeffelman said he lost his job over the accident and seeks at least $25,000 in damages, along with punitive damages.

Loeffelman also alleges in the documents that there have been a number of incidents at the Fred Weber landfill that should have alerted the company to the hazard. Loeffelman is being represented by Paul J. Passanante of Paul J. Passanante and Associates while Fred Weber is being represented by Patrick Mickey of Brown and James. Calls to both attorneys were not returned.


Clayton condo association seeks injunction to prevent tax sale of units; alleges breach of contract against director

According to court documents, the 700 S. Brentwood Condo Association is suing Shaw Credit Investments and Shaun Hayes, its director/registered Agent, for breach of contract concerning a settlement the two made in November.

The association is also seeking an injunction from St. Louis County judge Michael T. Jamison that would prevent a scheduled August tax sale on six of the units at both 8054 Davis Dr. and 700 S. Brentwood in Clayton.

700 S. Brentwood Condo Association says Hayes has failed to make payments for all unpaid and delinquent taxes on the units he agreed to make under the November agreement.

The association also alleges in the court documents that Hayes breached his fiduciary duty by undercapitalizing Shaw Credit Investments and stripping Shaw Credit of its assets to avoid creditors.

The association is asking for a judgement of $40,000, plus any additional taxes levied on or after Dec. 31. In addition, the association is asking the court to find that it is the equitable owner of the units as of Dec. 1 and to appoint a receiver to manage Shaw Credit.

Donna M. Webster is president of the association, which is represented by Todd Billy of the Law Offices of Marvin J. Nodiff. Hayes has been involved in a litany of litigation recently in regard to his association with Michael Litz and Bellington Realty.


Ray Vinson sued by California advertising service ReachLocal, which hired attorney that took Vinson for $300,000 in March

US Auto Protection topper Ray Vinson, who made a fortune pitching his American Equity Mortgage on local media with a distinctive voice reminiscent of actor Strother Martin, is being sued for breach of contract by California advertising service ReachLocal in the St. Louis County courtroom of judge Barbara Wallace.

According to court documents, ReachLocal  said it agreed to provide online advertising services for US Auto’s media campaign for a period of 12 cycles and US Auto agreed to pay ReachLocal approximately $40,000 each cycle.

ReachLocal required payment in advance and said Vinson in December guaranteed the contract. ReachLocal says US Auto breached the agreement by failing to pay and is seeking $150,000 in compensation for the cost of four campaign cycles, interest, attorney’s fees, and other costs, minus earlier payments by US Auto.

David P. Stoeberl and Meghan Lamping of Carmody MacDonald are representing ReachLocal. Stoeberl, a University City resident, served as lead trial counsel during a St. Louis jury trial that returned a $300,000 verdict in March against Vinson Mortgage Group in an unfair competition claim after finding that the company’s advertising misled consumers and interfered with American Equity Mortgage’s ability to conduct business.

Vinson and his ex-wife Deanna Daughhette founded American Equity Mortgage and she kept the business when they divorced while Vinson started Vinson Mortgage Group.
